Meltzer is reporting that all hope is not lost yet. Vince reportedly does want to use the "Broken" gimmick but wants to reach an agreement with Anthem first to make sure there are no legal repercussions. WWE feels that they're in the clear for the most part but does think Anthem would sue and Vince is being very risk-averse at this point. He sees no upside to a lawsuit even if he wins. WWE might be willing to pay a small amount (for them, it would be a lot for TNA) to buy the rights, or even agree to have a talent appear for 1 night only in TNA as they did in the past with Christian. The fact that Vince is willing to talk at all shows that he's pretty into the gimmick.  Vince has told Matt he can keep doing some of the smaller mannerisms to foreshadow the return of the gimmick, at least for now. 

TNA just lost a lawsuit today with their former production company to the tune of $330,000 and were forced to admit breach of contract in court. So it's good timing for WWE if TNA needs the money that badly.
