Terrible. How can they possibly equate this as "gambling" and a violation of probation?

It's actually a very common term of felony probation, and in this instance he was specifically prevented from buying lottery tickets.  Terms of probation usually include prohibitions against otherwise legal conduct, like owning or possessing forearms or associating with certain categories of people such as "known criminals".  I don't think the state can make him forfeit the money, but it sure can pull his probation and make him serve out the balance of his sentence.

And yes, I think it sucks in this instance.

Happened here, only playing the lottery is not a breach of parole terms.  Chap won £7m whilst in the nick.  Was then sued by a victim.
