If Bret didn't get the footage from the WWE, where did he get it from? This is a match that was professionally shot at a Challenge taping. As far as anyone knows, it never aired, not even as a match added to overseas broadcasts to account for less commercial time and/or fewer promos. That the WWE can't locate Bret vs. Magee from 1986 now doesn't mean it didn't have it when Bret apparently wanted a copy back in 1989. That said, unless the Tom Magee promo was meant for office consumption, which isn't out of the question, its inclusion on the tape suggests this might have slipped out on TV somewhere.

So what are the chances then that the E shot it, copied it, lost it and now will buy it back from a person that did transfers for Bret.

The NFL is going through a somewhat similar situation. Super Bowl I was aired by both NBC and CBS. This was the only time the game has aired on two different networks. Each network had its own announcing and production crews, airing distinctly different broadcasts. No one at either network thought to keep a copy of the game which was long thought to be lost forever, despite many searches for footage. A few years ago, a guy found a tape in his dad's possessions. His dad had worked at a CBS affiliate and taped an incomplete portion of the game (I think one half of the game) and then presumably put it away and forgot about it. Then his son found it.


The footage belongs to the NFL. The person who has the tape now can't show it or sell it legally. However, while the footage belongs to the NFL, the physical tape is the legal property of this person. He wants more money for it than the NFL will pay. The amount he wants is not outrageous, but isn't chickenfeed. The NFL's stance is it would like to have the footage and to compensate the guy with the tape, but it won't be held up for getting back footage it has the rights to, noting that the person with the tape is no position to legally benefit financially in any other way and would be sued from here to the Himalayas if he tries to profit illegally. The tape is in the possession of the Paley Center for Media in Manhattan, so its existence has been verified and it is safely stored. However, at this point no one can see the tape.

It's bizarre the NFL wouldn't pay if the sum isn't outrageous. They will make more off of it than what they will pay, there's no doubt about that.  And they don't have to worry about setting a precedent for getting held up in the future because this situation can never really happen ever again.  It's very unique to this one game.  Just be thankful someone taped half the game and just pay.
